Setup & Time to Launch
EOR: Fast—3–7 days. No entity registration, office lease, or capital requirements. Simply onboard employees via the EOR.
WFOE: Slow—8–20 weeks (2–5 months). Requires name approval, SAMR registration, registered capital commitment, office lease, bank account setup, tax registration, and company seal (*chop*) issuance.

WFOE: Your business assumes full compliance risk. You must ensure adherence to Chinese labor laws, tax regulations, and industry-specific rules (e.g., licensing for certain sectors). Non-compliance can lead to fines, suspension, or even revocation of the company’s license.
Scalability
EOR: Highly flexible—easily add or reduce staff within days. Ideal for short-term projects, market testing, or seasonal teams. No need to adjust legal or administrative structures when scaling.
WFOE: Scalable but requires more effort. Expanding team size, adding business scope, or relocating offices requires updating registration with authorities, which can take weeks. Better suited for long-term growth and permanent market presence.

Choose WFOE if :

You want full operational control and the ability to customize business strategies, policies, and branding.
You plan to scale significantly (hire 20+ employees, expand to multiple cities, or enter regulated industries).
You need to hold inventory, sign long-term local contracts, or repatriate profits freely.
